Terms & Conditions

Why read these Terms

By visiting Our Website and or purchasing something from us, you are engaging our “Services”, thus the following Terms and Conditions apply to you. If you do not agree, you should leave Our Website immediately. 

 

We may also amend these Terms from time to time. The Terms that apply to you, are those posted here on our website on the day you make your purchase. 

 

Definitions used

“Us”, “We”, “Our”, means Velvet Rani Couture. 

“You”, “Your”, “Customer”, means the customer and provisioner of our Services. 

“Our Website”, means www.velvetranicouture.com 

“Services” means your engagement with us, via Our Website, email, and or other means (social platforms, pop-ups) in the purchase of products from us. 

“Custom Pieces” means, orders for which we undertake additional work to supply goods, specific ally bespoke, made to measure and made to order items. 

 

Using our website

When you use our website, you represent that: 

  • You are the lawful age in your jurisdiction of residence, or that you have given your consent for your minor dependents to use our website. 

  • You will not use our products for any illegal or unauthorized purpose, nor may you in the use of the Service violate any laws in your jurisdiction (including but not limited to copyright laws). 

  • You will not transmit any worms or viruses or any code of a destructive nature. 

 

A breach or violation of any of the Terms will result in an immediate termination of your Services

1. Our contract with you

1.1 These terms and conditions apply to your purchase of our products, regardless of how the order is made (website or otherwise). No variation shall be binding unless agreed in writing by us.

1.2 Custom orders and sample pieces cannot be returned. Only stocked items will be eligible for return.

1.3 If you use our services on the behalf of another person, you accept personal responsibility for every act or omission by you. 

1.4 In circumstances beyond our control, we will not be liable for delays or failure to meet an obligation against these terms. 

1.5 When we communicate with you, we do so electronically. You agree that digital communications are contractually binding in the same way as properly signed and dated document sent by post. 

1.6 We reserve the right to withdraw any offer or special promotions without notice, in such case a full refund for such orders will be provided. 

1.7 Products may vary by a margin of +/- 1”. Should alteration be required, these will be your responsibility.

2. What we cannot guarantee

2.1 All images are for illustrative purposes. Actual colours may vary since every computer monitor has a different capability, and that everyone sees these colours differently.

2.2 We do our best to create designs, fabric and finishes, colours, and shades accurately, but this cannot always be guaranteed. Variations can be possible and are beyond our control; as such you understand that different production runs and varied computer monitor settings means that samples and images can vary.

2.3 Even with the best handling and care by us and you, garments with embellishments/embroidery (beads, stones, mirror sequins etc.) may come loose and fall off, be it during transit or whilst wearing.

2.4 We do our best to ensure that measurements specified are met but reserve the right to work within a tolerance margin of 1” (+/-), as such we do not provide, nor undertake alterations.

2.5 We cannot accept responsibility for orders not fitting due to increase or decrease in measurements or any other reason beyond our control.

The availability of fabrics and desired finishes cannot be guaranteed.

3. Accepting your order

3.1 Your order is an offer to buy products from us. It is conditional upon the items being intended for personal use and not for resale. We reserve the right to not enter such a contract. 

3.2 Your order is accepted when it enters the status of processing. We will email you to confirm the details of your purchase.

4. Ordering custom pieces [bespoke, made to measure and made to order]

4.1 Custom pieces are those items for which we undertake additional work, to supply goods that you have asked for. Given that these items are supplied at your request, and in cases to your specification they are ineligible for a refund.

4.2 Your order will only be confirmed when there is clear acceptance via an Order Invoice, or sign-off from you in writing, either via email or, as an order through the website. At any point up until then, we may decline your order without giving any reason.

4.3 The accuracy of the details submitted, and timeliness in providing all necessary information is your responsibility. We will not be liable for any costs and expenses because of inaccurate details or delayed responses.

4.4 If you wish to make any changes (style, measurements etc) to your specification, and should it be possible for us, you will be liable for the additional costs and impact to the delivery schedule.

4.5 We will only proceed with agreed changes on approval from you. In line with clause 4.2, specifications must be finalised in writing.

4.6 We accept no responsibility for orders not fitting due to the incorrect, increase or decrease in measurements, or any other reason beyond our control. In line with clause 2.3, as we reserve the right to work within a tolerance margin of 1” (+/-).

4.7 If you terminate your order before a custom order complete, you agree to pay us for all the work to the date of cancellation by you.

 

5. Taking care of your items 

5.1 The responsibility of a products after care and cleaning is that of the customers. To preserve quality, we recommend items pressed with care, on a cool iron setting and or hand steamed, professionally cleaned.  

 

6. Our prices 

6.1 Prices are subject to change, and without notice. These changes may include unforeseen issues or annual increases, or the occasional error. Where an incorrectly priced item has been purchased, we reserve the right to refuse or cancel the order. 

6.2 Prices of our products are shown on our website, but in some cases such as custom pieces the pricing agreement may be conducted in writing (email, telephone, SMS/social platform). 

6.3 Prices include value added tax (VAT), it is your responsibility to process the required VAT claims. 

 

7. Collecting payments and deposits  

7.1 We will not split orders and will require full payment (with funds cleared) before an order dispatched. 

7.2 Custom Orders will require a minimum 50% deposit to secure the order and a delivery slot. All other order types will need to be paid in full.  

7.3 Deposits are non-refundable, and non-transferable to other orders, or items within the order; they will not be returned in the event of cancellation of any part of the order.  

7.4 Card payments are not processed through pages controlled by us. We use a 3rd party payment service provider, who will encrypt your card or bank account details in a secure environment of their own. 

7.5 Bank charges for receiving payments will be borne by us. All other charges relating to payment in a currency other than Pounds Sterling will be borne by you. 

7.6 Any information given by us in relation to exchange rates are approximate only and may vary from time to time. The actual exchange rate charged for any purchase is out of our control. 

7.7 If, by mistake we have under-priced products, we will not be liable to supply those to you at the stated price, provided we notify you before we dispatch it to you. 

7.8 Our delivery charges are in addition to the goods and will be displayed (or agreed with) you before we ask you to pay. 

7.9 If we owe you money, we will credit your original payment method as soon as reasonably practicable, and no later than 14 days from the date when we accept that the repayment due. 

 

8. Accepting returns/refunds 

8.1 Cancellations and refunds do not apply to custom orders, nor sale or sample items purchased via website or otherwise, or any item purchased in-person. We will only process cancellation requests for stocked items purchased via the website. 

8.2 For full-priced stock items only. You may cancel and return your order within 14 days of receiving your delivery. You must first inform us via email that you wish to cancel, including your order number, and must send the item(s) back to us within 14-days. We do not offer exchanges. 8.3 We can only return money if items are returned in a condition in which we can re-sell them at full price, unworn, and still new; with labels and packaging intact, and accompanied by a returns number - we cannot return your money unless we do not know who sent the items back. 

8.4 When returning an item, you will need to pay the cost for returning shipping – this is non-refundable. Any return costs borne by us (custom charges, unpaid postage charge etc), will be deducted from your refund amount.  

8.5 We recommend using a trackable shipping method, as we are not responsible for any items lost in the post. You are responsible for the items until we receive them. 

 

9. Faulty items 

9.1 We do not accept returns unless defects reported within 48hrs of receipt of delivery, and pictures or video of the fault must be included. This does not affect your statutory rights. 

9.2 Before returning faulty items, ensure that you have obtained a returns number. See our returns page www.velvetranicouture.com/delivery-returns/ 

9.3 We can only return money for defective items if the item(s) returned with labels and packaging intact, accompanied by a returns number, and a clear description of the fault. 

9.4 If, on our inspection any defect is confirmed, we will repair or replace the item, or provide a credit note for the full cost paid, including the cost of returning the items. 

  

10. Our delivery schedules and shipping charges 

10.1 For stocked items we have a shipping time of 5-days, this is in addition to our 3-business days order processing time. 

10.2 For bespoke, made to measure, and made to order purchases, the lead time is noted on our website. For orders are processed outside our website, we will advise an estimated delivery date upon accepting your order. 

10.3 The cost of delivery will be calculated at checkout or provided as part of your final quote. 

10.4 Delivery processing and shipping times: 

  • Ready to Ship - 3 days processing, 2-4 days shipping

  • Made to Order - The approximate lead time for made to order items is 6-8 weeks. The estimated dispatch date will be confirmed after purchase.

  • Mixed Item Orders - Unless agreed, all items will be despatched in full (i.e., in-stock items will be shipped with your custom order), therefore the latest delivery date applies.

10.5 We will dispatch orders to the address provided by you. You must ensure that someone is present to accept delivery. 

10.6 Orders will only be dispatched upon receipt of cleared funds of the whole order.  

10.7 All orders will be sent as tracked, and the tracking number made available within 24hrs of dispatch. 

10.8 Should your order have been damaged in transit, please refuse the delivery and contact us – signing “unchecked” / “not checked” or the like is not acceptable. 

 

11. Foreign taxes and duties  

11.1 International orders will be shipped on a DDU (Delivery Duty Unpaid) basis, and may incur duties, fees, and import taxes upon delivery. Any additional charges incurred through customs or duties are your responsibility. 

11.2 If you are not in the UK, you are responsible for purchasing lawfully importable goods. For more information, please consult your local customs office. Once your order accepted, we cannot refund goods deemed exempt from import.

11.3 When returning an item, you will need to pay the cost for returning shipping – this is non-refundable, any return costs borne by us (custom charges, unpaid postage charge etc) will be deducted from your refund amount. 

 

12. Promotional codes, offers and vouchers 

12.1 Promotions, offers or vouchers, including giveaways are non-transferable and there is no cash alternative.  

12.2 They cannot be used in conjunction with any other promotion or offer including sale items and must be redeemed by the date published (where provided) or within 6 months. 

12.3 We have the right to refuse or cancel any order which has mistakenly been discounted with more than one voucher code or other promotional offers. You will be issued a full refund for any order cancelled under this clause. 

 

13. How we handle your content

13.2 If you post content to any public area of Our Website or Social instances, and it becomes available to the public domain we have no control who sees it nor what anyone does with it.  

13.3 Posting content of any sort does not change your ownership of the copyright in it. We have no claim over it, and we will not protect your rights for you. 

 

14. Intellectual Property 

14.1 The Intellectual Property in all work we do in the process leading to completion of the products and in the completed products belong to us. 

 

15. Jurisdiction 

15.1 For the avoidance of doubt if there should be any dispute under these terms and conditions or the contract between Velvet Rani Couture and the customer then such dispute shall be dealt with under English law.

Information about your statutory right to cancel  

 

Your right to cancel  

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel this contract within 14 days without giving any reason. The cancellation period will expire 14 days after the contract was made. That means you can cancel before your order delivered it to you.

 

How to cancel  

To meet the cancellation deadline, email us before the cancellation period has expired, indicating that you’d like to cancel.  

To exercise the right to cancel, you must inform us of your decision to cancel this contract by a clear statement that is sent to velvetranicouture@outlook.com or via the “contact us” page on our website. 

 

You may use the cancellation outline below, but you can use your own words as long as your intention is clear. Once your cancellation email has been received by us, we will process the refund or provide returns number (whichever is applicable). In the case where items are being returned by you, a refund for the items will be subject to: 

  1. Receiving items back in a condition that we can re-sell them at full price - this is unworn and still new. 

  2. Item labels and packaging intact  

  3. An accompanying order number, we cannot return your money unless we know who sent the items.
